Fire Permits & Fees
The Dayton Fire Code (DFC) requires securing a permit from the Dayton Fire Department Office of Fire Prevention before certain occupancies can be opened or activities be conducted. If you are required to obtain a permit by some provision of the Dayton Fire Code, the following provisions will be followed:
DFC 107.1 - Notice
It shall be unlawful to engage in any business activity involving the handling, storage or use of hazardous materials, substances or devices; or to maintain, store or handle materials; or to conduct processes producing conditions hazardous to life or property; or to install equipment used in connection with such activities; or to establish an assembly occupancy without first notifying the code official.
DFC 107.2 - Permits Required
Permits required for the various uses and activities as provided in the Dayton Fire Code. Issued permits shall be kept on the premises designated therein at all times and shall be readily available for inspection by the code official.
DFC 107.2.1 - Application for Permits
Application for permit required by the Dayton Fire Code shall be made to the Fire Official on a form provided by the Dayton Fire Department. Applications for permits shall be accompanied by construction documents, as required by the code official for evaluation of the application.
DFC 107.3 - Action on Application
Before a permit is issued, the Fire Official or his designated representative shall make or cause to be made such inspections or test as are necessary to assure that the use and activities for which application is made complies with the provisions of this code.
DFC 107.5 - Conditions of Permit
A permit shall constitute permission to maintain, store or handle materials, or to conduct processes which produce conditions hazardous to life or property, or to install equipment used in connection with such activities in accordance with the provisions of the Dayton Fire Code. Such permission shall not be construed as authority to violate, cancel or set asked any of the provisions of the Dayton Fire Code. Such permit shall remain in effect until revoked, or for such period of time specified on the permit. Permits are not transferable and any change in use, operation or tenancy shall require a new permit.
DFC 107.6 - Approved Plans
Plans approved by the Fire Official are approved with the intent they comply in all respects to the Dayton Fire Code. Any omissions or errors on the plans do not relieve the applicant of complying with all applicable requirements of the Dayton Fire Code.
DFC 107.7 - Revocation of Permit
The Fire Official may revoke a permit or approval issued under the provisions of the Dayton Fire Code, if upon inspection any violation of the Dayton Fire Code exists, or if any condition of a permit has been violated, or if there has been any false statement or misrepresentation as to material fact in the application, data or plans in which the permit or approval was based.
DFC 107.8 - Payment of Fees
A permit shall not be issued until the designated fees have been paid.
Obtaining a Permit
- Complete a permit application - Upon request, or on a periodic basis, the applicant will receive a Fire Prevention Permit Authorization Application. The applicant completes this application and attaches whatever additional information may be relevant or required.
- Applicant Signs the Permit Application
- Fire Department reviews/approves the Permit Application - Approval may require a site inspection, examination of the process or additional supporting information.
Use the Approved Permit Application to Obtain the Permit - The signed and approved permit application, along with payment for the amount indicated on the permit application, must be mailed or taken to:
